Understanding the Process of Social Security Disability

There are several steps in the process of filing and being approved for benefits.

Apply for benefits by:

  1. Going to the nearest Social Security office and filling out an application
  2. Calling the Social Security office to complete the application over the telephone
  3. Go online to the Social Security Administration’s Web site to fill out an application

After your application is filed, your claim will either be approved or denied at the initial application level. If your claim is approved, you can start to see benefits as early as a few months after filing.

Unfortunately, nearly 85% of all initial claims are denied by the Social Security Administration (SSA). If your claim is denied, do not be discouraged or think that your opportunity to obtain benefits is gone.

If you are denied:

After having your claim initially denied by the SSA, you must now go through the hearing stage. In this stage, claimants must meet with a Social Security Disability Judge, who will look over medical records and allow you to present your case about why you cannot work. The Judge will then make the decision to approve or disapprove your claim. The hearing process, unfortunately, can take 22-24 months.

At RGG Law, we can guide you through the entire process with care and personal attention. Former Disability Judge Martin Spiegel and the rest of the attorneys at our firm have helped countless numbers of clients receive the benefits that they deserve.
